These Terms & Conditions (“Terms”) together with our Privacy Policy (collectively, the “Agreement”) govern your use of Ozia’s website, applications, and related services (the “Services”). The Services are provided by Ozia (“we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility & Accounts

You must be at least 18 years old to use the Services. You agree to provide accurate and complete information when creating an account and to keep your credentials secure. You are responsible for all activity occurring under your account. We reserve the right to suspend or close accounts that breach these Terms or appear to be misused.

2. Service Access & Availability

You need an internet connection and a compatible device to use the Services. You are responsible for any data or connection charges. We aim to keep the Services available but may occasionally limit access for maintenance, updates, or technical reasons.

3. Subscriptions, Trials & Payments

Some features require a paid subscription (“Subscription”). Subscriptions may begin with a free or discounted trial. By starting a Subscription, you authorize us or our payment partners (e.g., Apple, Google, Stripe, PayPal) to charge your selected payment method for recurring fees and applicable taxes.

Automatic Renewal. Subscriptions renew automatically at the end of each billing cycle unless cancelled. You can cancel at any time through your app store or your account settings. Cancellation takes effect at the end of the current period.

Right of Withdrawal (EU). If you are an EU consumer, you have the right to withdraw from your purchase within 14 days of starting your Subscription—unless you begin streaming or downloading content during that period. By starting playback, you acknowledge that you waive your withdrawal right.

Refunds. Except where required by law, payments are non-refundable. We do not provide partial refunds for unused periods. If you believe you were charged in error, please contact us at support@ozia.live.

4. Personal Licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app and its content for your private, non-commercial use in accordance with these Terms. All rights not expressly granted remain with us.

5. Acceptable Use

You agree not to:
• Copy, share, record, or publicly perform our audio or content;
• Circumvent technical protections or share your account;
• Use the Services for unlawful purposes;
• Introduce malicious software or interfere with our systems;
• Violate applicable territorial or usage restrictions.

6. Intellectual Property

All sound recordings, compositions, software, code, graphics, trademarks, and related materials (“Content”) are owned by Ozia or its licensors and protected by copyright and other intellectual property laws. You may not use the Content except as expressly allowed under these Terms.

7. Third-Party Services

The Services may use or link to third-party providers (e.g., payment gateways, analytics, push notifications). Their terms and privacy policies apply. We are not responsible for third-party services.

8. Health & Safety Notice

Our sound experiences are designed for relaxation, focus, and well-being. They are not a substitute for medical or psychological treatment. If you have a medical condition or are sensitive to audio stimuli, consult a professional before use. Do not use the app while driving or performing tasks that require full attention.

9. No Warranty

The Services are provided “as is” and “as available.” We make no representations or warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be error-free or uninterrupted.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services. In any case, our total liability shall not exceed the amount you paid to Ozia in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Ozia harmless from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or misuse of the Services.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your account if you breach these Terms or misuse the Services. Sections relating to intellectual property, liability, and governing law will survive termination.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy and the European Union. Any dispute shall be subject to the exclusive jurisdiction of the courts of Italy, without prejudice to any mandatory consumer protections available in your country of residence within the EU.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will be published in the App and on our website. Continued use of the Services after changes take effect means you accept the updated Terms.
